Roles and Scope

iSeatz acts as a “controller” (or “business,” as that term is used under certain U.S. state privacy laws) for Personal Information we collect and process through our corporate website, marketing, sales, recruitment, and direct customer relationship activities.

When iSeatz provides products or services to a customer through a white-labeled, co-branded, or customer-branded environment (including where end-users access iSeatz systems behind the scenes), the customer generally acts as the “controller” (or “business”) and iSeatz acts as a “processor” (or “service provider/contractor”), processing Personal Information solely on the customer’s documented instructions and as described in applicable agreements, including any data processing addendum (“DPA”) and/or service terms. In these scenarios, end-users should also review the customer’s privacy notice for additional information about the customer’s data practices.

Information for California Residents

The California Consumer Privacy Act (CCPA) applies to information collected from California residents. Residents of California have the following rights with regard to their personal information:

California residents may submit a verifiable request regarding the information collected, the types of sources from which personal Information is collected, the purposes for which information is collected, and the specific personal information collected about them.

We do not sell Personal Information to third parties (as those terms are defined under applicable California law, including the California Consumer Privacy Act of 2018, as amended by the CPRA). We also do not “share” Personal Information for cross-context behavioral advertising as defined under the CPRA.

The section herein entitled “What Personal Information We Collect” identifies the categories of Personal Information that we have collected in the preceding 12 months. The categories of information may change from time to time based on a multitude of factors, such as business requirements or applicable laws.

Sensitive Personal Information

We do not collect, sell, or share Sensitive Personal Information through our corporate website as defined under the CPRA.

Retention Criteria

If a specific retention period is not listed, we retain Personal Information only for as long as reasonably necessary to fulfill the purpose for which it was collected, including security, analytics, compliance with legal obligations, and maintaining business records. Information is deleted or de-identified when no longer needed for these purposes

International Data Transfers

Personal Information may be transferred from users residing in the European Union to our servers, partners, or vendors located in the United States and other non-EU countries where there may not be an adequacy opinion issued with respect to that country. We have taken appropriate safeguards to ensure that Personal Information remains protected wherever it is transferred. When we transfer Personal Information of individuals in the European Economic Area (“EEA”), Switzerland or the United Kingdom (“UK”) to the US, we make use of the Standard Contractual Clauses and the UK Addendum as well as additional safeguards where appropriate.

We take all reasonable steps to protect the information we receive from you from accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access. We have put in place appropriate physical, technical, and administrative measures to safeguard and secure your information, but no security measures are perfect; the risk of a data breach is possible.

  • Personal information is encrypted at rest at our data centers.
  • Employees are given access to users’ personal information only on a “need to know” basis.
  • All employees are required to receive training on information security.
  • All employees with access to personal information are subject to background checks.
  • All employees with access to personal information are required to sign a binding confidentiality agreement.
  • Before sharing personal information with our vendors, we make sure they have implemented security procedures to protect your data. Our vendors and partners are not permitted to use or share your information for any purpose other than to provide the services for which they have been contracted.
  • We periodically assess risks to personal information and update our safeguards as systems, threats, and regulatory requirements evolve.

Automated Decision Making and Profiling

This section applies to our corporate website and general services. Automated processing used solely to facilitate transactions, bookings, redemptions, platform functionality, fraud prevention, system security, or service operations does not constitute automated decision-making producing legal or similarly significant effects within the meaning of applicable data protection laws.

We do not engage in solely automated decision making or profiling on our corporate website that produces legal or similarly significant effects for individuals.

We do not use automated processes to make decisions about access to our services, eligibility, employment considerations, or any other outcomes that would meaningfully affect you.

We may use standard analytics tools to understand how visitors interact with our website, but these tools do not make decisions about individuals, do not create user profiles for automated decision making, and do not have any significant impact on your rights or experience beyond helping us improve the performance and usability of the site.

We do not use artificial intelligence, machine learning, or other automated systems on our corporate website to make decisions that produce legal or similarly significant effects on individuals, or to engage in profiling in a manner that would materially affect individuals’ rights or interests.

Where automated or algorithmic tools are used to support analytics, security, fraud prevention, system performance, or service operations, such tools are limited in scope, are not intended to evaluate or score individuals, and are not used for purposes that would constitute ‘high-risk’ artificial intelligence systems under applicable laws, including the EU Artificial Intelligence Act.

Any use of automated systems is designed to support platform functionality and operational integrity and does not replace human oversight in decisions that could have a meaningful impact on individuals.

Notwithstanding the foregoing, if applicable laws or guidance regarding artificial intelligence or automated decision-making evolve, we will review and update our practices and disclosures accordingly.

Children’s Privacy

Our websites and services are not directed to children and we do not knowingly market our services to children.

We do not knowingly collect or solicit personal information from children under age 13 without parental consent, unless permitted by law. If we become aware that we have collected personal information from children under the age of 13 without parental consent (or as permitted by law), we will delete it. If you believe that a child may have provided us with personal information without such parental consent, please contact us.

California consumers: We will not sell the information of California consumers who are 16 years old or younger unless we have prior parental authorization. If a California consumer is under the age of 13, a parent or guardian must consent to the sale of such minor’s personal information.
